What Is Rehabilitative Alimony?
According to California Family Code Section 4320 (a),
In a judgment of dissolution of marriage or legal separation of the parties, the court may order a party to pay for the support of the other party an amount, for a period of time, that the court determines is just and reasonable, based on the standard of living established during the marriage, taking into consideration the circumstances as provided…
When the court determines that it is just and reasonable to award spousal support for a limited amount of time, they may award the receiving party with rehabilitative alimony. This type of payment is most often ordered when one party requires a certain amount of time to get back on their feet by completing their degree in school, completing training to rejoin the workforce, etc. In many cases, the party receiving payments put these endeavors on hold to help with marital or familial duties, like raising children.
